1. About these terms
These terms apply to your use of vitaloop.in (the “Website”), which is operated by VITALOOP LLP (LLPIN ADC-3019), registered office: Flat No. 7, Bldg B4, Sarita Nagari Phase-II, S.P. College, Sinhgad Road Police Station, Pune City, Pune – 411030, Maharashtra, India (“Vitaloop”, “we”, “us”). By using the Website you agree to them. If you do not agree, please do not use it.
A hospital or clinic that buys the Vitaloop platform is bound by a separate written agreement. If that agreement conflicts with these terms, the agreement prevails for the platform.
2. Using the Website
You may use the Website for lawful purposes and in line with these terms. You must not:
- break, probe or overload the Website, or interfere with other people’s use of it;
- copy, scrape or extract its content by automated means, beyond what a search engine or an ordinary browser does;
- post to the game leaderboard anything unlawful, offensive, misleading or that identifies another person;
- use automated means to submit scores or requests; or
- use the Website to infringe anyone’s rights or break any law.
3. About the information on this Website
Vitaloop is pre-launch. The Website describes the platform we are building. Those descriptions are not offers, promises or warranties. They may change, and any feature, timeline or regulatory status is stated as of the date shown on the relevant page. Our regulatory position is on the ABDM & regulatory status page.
The Website is for information. It is not medical advice and is not a medical device. Do not use it to make clinical decisions, and do not use it in an emergency.
4. Personal data
Please do not send patient names, medical record numbers or other health information to us through the Website or by email. Our Privacy Policy explains what we collect and how you can exercise your rights.
5. The game and leaderboard
The medivac game is for fun. Nicknames and scores you submit are public. We may remove any entry at any time. See section 5 of our Privacy Policy.
6. Third-party services
The Website relies on outside providers, including those listed in section 3 of our Privacy Policy. Their own terms and privacy policies apply to the parts they provide, and we are not responsible for them. Links to other websites are for your convenience and do not mean we endorse them.
7. Intellectual property
The Website, its design, code, text, graphics, name and logo belong to VITALOOP LLP or its licensors and are protected by law. Except as these terms allow, you may not copy or reuse them without our written permission. If you send us feedback or suggestions, you allow us to use them freely without obligation to you.
8. Availability and changes
The Website is provided “as is” and “as available”. We may change, suspend or withdraw any part of it at any time. We do not promise that it will be uninterrupted or error-free.
9. Disclaimers and limits on liability
To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. To the same extent, we are not liable for indirect, incidental or consequential loss, for loss of data or profit, or for any decision made using the Website. Because the Website is free, our total liability to you for any claim about it is limited to the amount you paid us for it, which is nil. Nothing in these terms limits liability that cannot lawfully be limited, or affects rights you have under law that cannot be waived.
10. Suspension
We may suspend or end your access to the leaderboard or the Website if you break these terms or put the Website or other users at risk. You may stop using the Website at any time.
11. Changes to these terms
We may update these terms. The version number and date at the top of this page show which version is current. If a change matters to you, we will say so on this page. Using the Website after a change means you accept the updated terms.
12. Governing law and disputes
These terms are governed by the laws of India. Subject to any rights you have that cannot be excluded, the courts at Pune, Maharashtra have exclusive jurisdiction over any dispute about them. Before starting proceedings, please write to us so we can try to resolve the matter.
